This Privacy Policy describes how Tesseract Data Services (also referred to below as“TDS” “we”, “us”, and “our”) may collect, use, disclose, and dispose of information that identifies or is capable of identifying you as a natural person (“Personal Information”).

TDS maintains this Privacy Policy and makes it available through the TDS website (www.tesseractdata.com) (the “Website”).

  1. WHEN AND HOW WE COLLECT PERSONAL INFORMATION

We may collect Personal Information when you or someone on your behalf:

    • Accesses the Website.
    • Fills-in and submits web forms via the Website or any one of our Website.
    • Requests access to or utilize our systems for the delivery of services
    • Communicates with us through any digital or physical means.
    • Submits a resume, cover letter, or other employment-related documentation.
    • Signs up for any TDS live or virtual event.
    • Interacts with us directly over the phone, in person, or at any live or virtual event.

We also may receive Personal Information through third-party sources we contract to provide us with sales or marketing support.

      1. HOW WE USE PERSONAL INFORMATION

      We may use Personal Information to:

        • Ensure our ability to effectively communicate with current and potential clients, deliver quality services, and improve our business relationships.
        • Control access to our systems.
        • Deliver promotional sales, marketing, and educational materials (see Section 4, below).
        • Facilitate and manage your registration, reminders, and attendance at live or virtual events.
        • Fulfill any reporting obligations to CLE authorities.
        • Track Website visitors via cookies and other web technology (see Section 5, below).
        • Respond to your request to access or download content from our Website.
        • Improve the function and operation of our Website.
        • Track, assess, and make determinations regarding employment or staffing.
      1. WHEN WE DISCLOSE PERSONAL INFORMATION

      TDS does not sell Personal Information. We may, however, share or disclose your Personal Information to:

        • Fulfill our reporting obligations to CLE authorities when you request CLE credit for attending an TDS-sponsored CLE event.
        • Ensure your authorized access to our services.
        • Deliver to you promotional marketing or educational materials.
        • Publish a testimonial that has been voluntarily provided and for which we have been authorized to publicly share.
        • Additionally, we may, if and as required, disclose your Personal Information to law enforcement agencies, other governmental agencies or health authorities when:
        • Such disclosure is required to satisfy any law, regulation or other lawful governmental demand.
        • You have committed an unlawful act and no privilege or other recognized legal protection applies.
        • You have taken an action that intentionally interferes with the operation of our business, services or Website.
        • It we deem it necessary to protect and defend our legal rights or the rights of our personnel, clients, even without a subpoena, warrant, or court order, and no privilege or other recognized legal protection applies.
        • It is necessary to prevent an imminent threat of harm to the health, safety, and welfare of our personnel, clients, or guests.
      1. HOW TO OPT-OUT OF COMMUNICATIONS

      If you would like to opt-out of receiving promotional sales, marketing, or other materials from TDS, you may: (i) use the “Unsubscribe” button on the bottom of any email sent to you from TDS; or (ii) send an email to  info@tesseractdata.com with the subject line “REMOVE”.  Please allow for up to ten business days for TDS to process your request.

      1. COOKIES AND RELATED TECHNOLOGIES

      The TDS Website may use cookies, along with other related technologies, to keep track of how users interact with us across platforms. We also use cookies to improve and enhance our Website, including measuring user interaction and flow through our Website.  You may reject cookies from our Website and still use any portion of our Website.  We also may use advertising providers across various platforms to promote our services and track the results of our efforts.

      1. HOW LONG WE RETAIN PERSONAL INFORMATION

      We retain Personal Information for the duration of our business relationship, or until one of the following events, prioritized by order of operation:

        • The end of the period we are required to retain that information to comply with tax or other applicable laws or regulations.
        • You choose to opt-out.
        • You otherwise request we delete your Personal Information as provided by applicable law (e.g., the California Consumer Privacy Act, see Section 8, below).
        • We determine, in our sole discretion, that we have reached the end of our business relationship.
      1. LIMITATION OF LIABILITY

      Without limiting any other terms in this Privacy Policy, you understand that we cannot guarantee that your Personal Information will always be private or secure. In the unlikely and unfortunate event of a data breach, TDS will adhere to data breach notification requirements and incident reporting obligations to supervising authorities and/or data subjects, as required by applicable laws. The substance and time frames applicable to these remedies are set forth in applicable laws.

      You agree, to the extent permitted by law, that TDS is not responsible or liable to you for any direct or consequential loss of privacy or security you may experience. You are fully responsible for taking appropriate precautions and security measures best suited for your situation and the intended use of our Website and our services.

      1. FOR CALIFORNIA RESIDENTS

      1. FOR EUROPEAN DATA SUBJECTS

      While TDS is a U.S. company, we respect the human rights of data subjects in the EU, EEA, EFTA, and beyond. To the extent that you, as a European data subject, choose to use our Website or voluntarily provide us with your Personal Data, as that term is defined under Article 4 of the EU GDPR, you may send us an appropriate request as set forth in Articles 15-22 and we will endeavor to fulfill that request in good faith.  European data subject requests should be sent to  info@tesseractdata.com with the subject line: “GDPR DSR” along with any required documentation.  Without accepting or acknowledging any obligation whatsoever, we will review and assess such requests as set forth under Articles 12-14.

      1. FOR DATA SUBJECTS OUTSIDE EUROPE AND THE UNITED STATES

      TDS respects the human rights of data subjects around the world. As such, if you wish to assert data protection rights that you may have in your own jurisdiction relating to any Personal Information collected by us, you may make a request to TDS to exercise those rights.  Please send any such requests to  info@tesseractdata.com with the subject line: “GLOBAL DSR,” and include the appropriate documentation and citation to the applicable law (including English translation if the original is only provided in non-English language).  Without accepting or acknowledging any obligation whatsoever, will review and assess such requests as set forth under the applicable laws.

      1. ABOUT MINORS

      TDS does not knowingly collect Personal Information from children under the age of 13.  Our Website is not intended for children under the age of 13.  If you are under the age of 13, please do not use our Website.  If a child has accessed our Website and provided Personal Information without parental or guardian consent, the parent or guardian of that child may contact us by emailing  info@tesseractdata.com with the subject line: “CHILD PRIVACY”.  We will promptly take reasonable steps to remove and destroy any Personal Information of that minor from our systems.

      We may update this Privacy Policy from time to time to reflect changes in our business and privacy practices.  Updates to this Privacy Policy will be reflected with the Effective Date stated at the top of this document / page.  If you object to the Privacy Policy or any modification thereto, you may cease your interaction with TDS and notify us of your determination to Opt-Out as provided above.
